Standard Terms and Conditions
Set forth below are the standard terms and conditions which shall be integrated into and become part of each Data Acquisition and Use Agreement entered into TheTuitionE website and a Data Provider who will provide access to Data Provider’s and/or provide other sources of data, to allow TheTuitionE to apply its proprietary Platform and thetuitione.com (as those terms are defined below) to collect and organize Data Provider’s Data from Visitors to provide Services. Specifics about the Data Provider’s Data to be provided to TheTuitionE by Data Provider and any changes to the T&C’s for specific Data Providers will be set forth in one or more Services executed by TheTuitionE and the Data Provider. By accepting the T&C’s, each party agrees that they have accepted these T&C’s as they appear on thetuitione.com and have agreed that these T&C’s form the Agreement relating to the collection and use of Data Provider’s Data entered into between the parties.
Customer’s Data Collection and Retention
We collect your Personal Data (Contact Information, such as name, email address, phone number, geographic location, or phone number, Information to enable us to check and verify your identity, e.g. your date of birth, Billing Information, such as debit card number, credit card number and billing address, Reviews or ratings, syllabus and course preferences, and Information provided to us through our service, interaction with our customer service, participation in surveys or marketing promotions )when you register with us, when you express an interest in obtaining information about us or our products and services, when you participate in activities on our Website or otherwise contact us.
We will use your personal information to provide, analyse, administer and improve our services, to provide you with a personalized experience on our Website (especially, by offering you services that is best suited for you), to contact you about your account and our services, to provide you customer service, to provide you with personalized marketing and to detect, prevent, mitigate and investigate fraudulent or illegal activities. We further use your personal information to determine your general geographic location, provide localized courses and classes, provide you with customized and personalized study material, recommendations and help us quickly and efficiently respond to inquiries and requests and enforcing our terms (such as determining free trial eligibility) and communicate with you concerning our service (for example by email, push notifications, text messaging ,and online messaging channels), so that we can send you details about new features and content available on the Website, special offers, promotional announcements, surveys.
In case of payments via credit or debit card, we will redirect you to registered payment gateways. You may store and save your payment details like card numbers with the gateway. We do not have access to this data. All payment transactions are processed through secure payment gateway providers. We do not store any card information (except last 4 digits of the card number).
Data Protection and Sharing
TheTuitionE will be responsible for maintaining appropriate security practices to ensure that all Data Provider’s Data obtained by TheTuitionE from Visitors, or received directly from Data Provider, is kept in a secure environment, will be used only in accordance with the applicable privacy policy of Data Provider. No Data Provider’s Data will be disclosed to any Customer or irrelevant third party except in aggregate form unless agreed upon by the Data Provider.
We may use other Service Providers to perform services on our behalf or to assist us with the provision of services to you. We may engage Service Providers to provide marketing, advertising, communications, infrastructure and IT services, to personalize and optimize our service, to process credit card transactions or other payment methods, to provide customer service, to collect debts, to analyze and enhance data (including data about users’ interactions with our service), and to process and administer consumer surveys. In the course of providing such services, these Service Providers may have access to your personal or other information. We do not authorize them to use or disclose your personal information except in connection with providing their services.
TheTuitionE reserves the right to use these data for similar other services launched by TheTuitionE.
Representations
Downloader is not bound by any pre-existing legal obligations or other applicable laws that prevent Downloader from downloading or using the Materials from Tutione website;
Downloader will not use the Materials in any way prohibited by applicable laws;
Downloader has no knowledge of and will therefore not be responsible for any restrictions regarding the use of Materials beyond what is described in this Agreement; and
Downloader has no knowledge of and will therefore not be responsible for any inaccuracies and any other such problems with regards to the content of the Materials.
obtain information from the Materials that results in Downloader or any third party(ies) directly or indirectly identifying any research subjects with the aid of other information acquired elsewhere;
produce connections or links among the information included in TUTIONE’s datasets (including information in the Materials), or between the information included in TUTIONE’s datasets (including information in the Materials) and other third-party information that could be used to identify any individuals or organizations, not limited to research subjects.
Representations and Warranties
TheTuitionE REPRESENTS THAT WE HAVE ALL RIGHTS REQUIRED TO MAKE AVAILABLE AND DISTRIBUTE THE MATERIALS. EXCEPT FOR SUCH REPRESENTATION, THE MATERIALS IS PROVIDED “AS IS” AND “AS AVAILABLE” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED.
WITHOUT LIMITING THE FOREGOING, TheTuitionE DOES NOT WARRANT THAT: (A) THE MATERIALS ARE ACCURATE, COMPLETE, RELIABLE OR CORRECT; (B) THE MATERIALS FILES WILL BE SECURE ; (C) THE MATERIALS WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (D) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (E) THE MATERIALS AND ACCOMPANYING FILES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (F) THE RESULTS OF USING THE MATERIALS WILL MEET DOWNLOADER’S REQUIREMENTS. DOWNLOADER’S USE OF THE MATERIALS IS SOLELY AT DOWNLOADER’S OWN RISK.
Indemnification
Downloader will indemnify and hold TheTuitionE harmless from and against any and all loss, cost, expense, liability, or damage, including, without limitation, all reasonable attorneys’ fees and court costs, arising from the i) Downloader’s misuse of the Materials; (ii) Downloader’s violation of the terms of this Agreement; or (iii) infringement by Downloader or any third party of any intellectual property or other right of any person or entity contained in the Materials. Such losses, costs, expenses, damages, or liabilities shall include, without limitation, all actual, general, special, and consequential damages.
Consent
By submitting data to us or our agent or using the Site, you consent to our use of your data in the manner set out in this Privacy Policy.
Changes to this Privacy Policy
Tutione may at any time modify the Terms of Use of our Website without any prior notification to you. Should you wish to terminate your contract due to a modification to the Terms or the Privacy Policy, you may do so emailing us at contacts@thetuitione.com. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified Terms of this Website.
Force Majeure
Neither party shall be liable for delays or failure in service performance under this Agreement caused by acts of God, war, acts of terrorism, work stoppage, fire, act of government, or any other cause, whether similar or dissimilar, beyond the control of that party.
Miscellaneous
By accepting the mentioned T&C’s, No agency, partnership, joint venture, or employment relationship is created as a result of the Agreement and neither party has any authority of any kind to bind the other in any respect outside of the terms described within this Agreement. In any action or proceeding to enforce rights under the Agreement, the prevailing party will be entitled to recover costs and attorneys’ fees.
